Data Processing Addendum

This addendum is part of the Terms of Service between Aspatuck LLC, a New York limited liability company, 170 Main St, Unit 258, Westhampton Beach, NY 11978 (“we”, “us”), and the company that uses PTO Fox (“you”, the “customer”). It covers the information about your employees that you keep in PTO Fox. Words not explained here mean what they mean in the Terms.

Roles

You control the information about your employees: you decide what to record and who may see it. We process it on your behalf.

Use

We process the information only to provide PTO Fox, following your instructions, which are the settings you choose and the actions your people take in the product, and these terms. We don’t sell it or use it for anything else.

Staff

Anyone who works for us and can reach your information is bound to keep it confidential, and reaches it only when the work needs it.

Security

We protect the information with the measures our Privacy Policy describes.

Vendors

We use the providers listed on our subprocessors page. We update that page before adding a new provider that handles employee data, and we hold our providers to obligations that protect the information at least as well as these.

Help with requests

If an employee asks to see, correct or delete what you keep about them, we will help you answer, through the product or at support@ptofox.com. If an employee asks us directly, we will point them to you.

Incidents

If we learn that your information has been accessed without permission, we will tell your admins without undue delay, with what we know and what we are doing about it.

End of service

You can export your information to CSV at any time. We delete it as the Terms say: within 30 days of being asked or of the account being closed, and a paused account after 12 months, once we have emailed your admin 30 days ahead.

Audits

On reasonable request, we will give you the information you need to check that we keep these terms, such as answers to a security questionnaire. We don’t offer on-site audits.

Liability

This addendum is subject to the limits of liability in the Terms.

Where

PTO Fox is offered to companies in the United States, and your information is stored and processed in the United States.
