Terms of Service

These terms are an agreement between Aspatuck LLC, a New York limited liability company (“we”, “us”), which provides PTO Fox at ptofox.com, and the company that signs up for it (“you”, the “customer”), including everyone the customer lets use it. By creating an account or using PTO Fox, you agree to them.

What PTO Fox is

PTO Fox is an online tool for recording employees’ time off, showing who is out, and handling time-off requests. It is not a payroll system, an HR system, a time clock or legal advice. Balances in PTO Fox are worked out from the rules and records you enter; your payroll system and your own policies remain the record of what employees are owed and paid.

Accounts

Each company has at least one administrator, who decides who else has access and what they can see. You are responsible for the accuracy of what you enter, for inviting only people who should have access, and for keeping sign-in details private. Tell us at support@ptofox.com if you think an account has been misused.

Your data

What you and your employees enter belongs to you. We use it only to provide PTO Fox to you, as our Privacy Policy describes, and we do not sell it. You can export a person’s records at any time, and you can ask us to delete your company’s data. You confirm that you are allowed to enter the information you put into PTO Fox, including your employees’ names and time off.

Acceptable use

Don’t use PTO Fox for anything unlawful, to store information it isn’t meant for (such as Social Security numbers, bank details or medical records), to get at another company’s data, or to disrupt the service.

Price

PTO Fox is currently provided free of charge. If we introduce paid plans, we will tell you in advance, and you will not be charged unless you choose a paid plan.

Availability and changes

We work to keep PTO Fox running and your data safe, but we can’t promise it will always be available or free of errors. We may improve or change features; if we make a change that takes away something you rely on, we will tell you ahead of time where we can.

Ending

You can stop using PTO Fox at any time. We may suspend or close an account that breaks these terms. Either way, you can ask for an export of your data, and we will delete it on request or within a reasonable time after an account is closed.

No warranty and limited liability

PTO Fox is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, or for decisions made on the basis of balances or calendars shown in PTO Fox, and our total liability to you is limited to the amount you paid us in the twelve months before the claim (which, while PTO Fox is free, is zero).

General

These terms are governed by the laws of the State of New York. We may update them; if a change is significant, we will tell administrators before it takes effect, and continuing to use PTO Fox after that means you accept it. Questions: support@ptofox.com.
